These Terms and Conditions ("Terms") govern your use of the website namengwe.com and the services provided by The Rug & Fabric Care Company (ABN and business details as registered), operating as Namengwe ("we", "us", "our"). Our business is located at 92 Woonona Avenue, Wahroonga NSW 2076, Australia.

1. Acceptance of Terms

By accessing our website, requesting a quote, booking a service, or engaging us to perform any fabric, rug, or leather care services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

2. Description of Services

We provide professional fabric, upholstery, rug, and leather care services including but not limited to:

  • Upholstery cleaning and care
  • Rug cleaning, restoration, and repair
  • Leather treatment and conditioning
  • Textile and fabric protection treatments
  • Stain removal and general maintenance

Services are performed on-site at your premises or at our facility, as agreed at the time of booking. We reserve the right to decline services where items are unsuitable for our methods or where we reasonably believe the work may cause damage.

3. Booking and Cancellation

3.1 Booking

Bookings may be made via our website, phone (1300 685 203), or email (info@namengwe.com). A booking is confirmed only when we have acknowledged it in writing or by phone. We will provide an estimated date and time; actual arrival may vary due to traffic, weather, or prior job complexity.

3.2 Cancellation by You

If you need to cancel or reschedule, please provide at least 24 hours' notice. Cancellations with less than 24 hours' notice may incur a cancellation fee of up to 50% of the quoted service value. Repeated no-shows or last-minute cancellations may result in a deposit requirement for future bookings.

3.3 Cancellation by Us

We may cancel or reschedule services due to circumstances beyond our control, including severe weather, equipment failure, or staff availability. We will endeavour to give reasonable notice and will reschedule at no extra charge where possible.

4. Pricing and Payment

4.1 Quotes

Quotes provided are estimates based on the information you supply. Final pricing may vary if the actual scope of work differs (e.g., additional items, heavier soiling, or unforeseen conditions). We will advise you of any significant variation before proceeding.

4.2 Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, EFTPOS, credit card, and bank transfer. For larger jobs, we may require a deposit before commencement. Invoices not paid within 14 days may attract interest at 2% per month and recovery costs.

4.3 GST

All prices are inclusive of GST unless otherwise stated. We are registered for GST and will provide tax invoices where applicable.

5. Liability Limitations

We take every care with your items. However:

  • We are not liable for damage arising from pre-existing conditions, inherent fabric weaknesses, age-related deterioration, or materials that cannot withstand standard cleaning processes.
  • We recommend disclosing any known issues (e.g., delicate fabrics, previous repairs, colour-fastness concerns) before we commence work.
  • Our liability for any claim arising from our services is limited to the amount paid for that specific service, or the cost of repair or replacement of the affected item, whichever is the lesser.
  • We are not liable for indirect, consequential, or incidental losses including loss of use, inconvenience, or emotional distress.

Nothing in these Terms excludes, restricts, or modifies any consumer rights or remedies under the Australian Consumer Law that cannot be lawfully excluded.

6. Intellectual Property

All content on namengwe.com, including text, images, logos, and design elements, is owned by The Rug & Fabric Care Company or our licensors. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

7. Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia. Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.

8. Changes to Terms

We may update these Terms from time to time. The "Last updated" date at the top indicates when changes were last made. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
